Increasingly, electrical technology is a cause of fires and source of risk for life and limb. Today, electricity is needed in all areas. This leads to increasing liability problems and ever new risks arising.
The legislator increasingly shifts to companies the tasks relating to supervision and monitoring duties for technical plant to companies. However, due to a lack of relevant knowledge, many companies neglect their duties according to the Ordinance on Industrial Safety and Health (Betriebssicherheitsverordnung - BetrSichV). The company, operator, employer or landlord always assumes the final operator responsibility for the safe operation of his electrical plant and operating resources in relation to employees, third parties, authorities and the environment. This means high personal exposure to liability risks and, in the event of any damage occurring, even criminal prosecution. As a result of changing legal framework conditions, liability risks for companies and responsible persons increasingly and continuously intensify.
Comprehensive knowledge of the relevant technical regulations and standards as well as correct behaviour, in addition to documentation in accordance with the respective requirements and equipment, that is comprehensible and usable in court, provides safety and protects against cases of liability. As a rule, this prevents intent or gross negligence.
