What is the Construction Products Regulation (CPR)?

The new Construction Products Regulation (CPR) came into force on January 7, 2025, modernizing the legal framework for the marketing of construction products in the EU internal market. For validation bodies in the assessment and verification procedure for performance consistency 3+, this means a gradual introduction of new requirements, particularly in the areas of sustainability, environmental performance, and digital product information.


A key element of the new CPR is the product-related validation report (Declaration of Performance and Conformity), which will be mandatory in the future and transparently documents the environmental and sustainability characteristics of a construction product. These requirements will become binding after the planned transition period, starting on January 8, 2026.

For whom is the CPR validation relevant?

Validation in accordance with AVS 3+ affects almost all players in the construction products industry. These include manufacturers of construction products with hEN/hTS or EAD reference, importers and authorised representatives, manufacturers of reused or dismantled construction products as well as system providers and component manufacturers such as insulation, wood-based material, concrete or façade system producers. Companies that rely on transparent sustainability data at an early stage also benefit from a validated environmental assessment. The validation also indirectly supports planners, architects and building owners who are dependent on reliable ecological product data for tenders and building certifications.

 

Is TÜV NORD a notified validation body according to AVS 3+?

We are aiming to be designated as a notified validation body in accordance with AVS 3+ under the new Construction Products Regulation (EU) 2024/3110 and are already aligning ourselves with the future requirements for such bodies. The regulation obliges manufacturers to transparently disclose the environmental sustainability of their construction products. In future, the AVS 3+ assessment and verification system will be mandatory for numerous product groups.

Frequently asked questions

Validation in accordance with AVS 3+ will become a central component of CE marking under the new Construction Products Regulation (EU) 2024/3110. Together, these regulations will lead to greater transparency and better evidence of performance and sustainability. This will provide designers, authorities, and building owners with reliable data.

The Construction Products Regulation refers to standard EN 15804: “Sustainability of construction works - Environmental product declarations.” This standard provides a structured framework for recording and communicating environmental information, which makes it easier to assess and compare the sustainability of construction products.

The notified body shall decide on the issuing, restriction, suspension or withdrawal of the validation report on the basis of:

  1. validation of the input values, assumptions made and compliance with applicable generic or product category specific rules;
  2. validation of the manufacturer’s assessment;
  3. validation of the process applied to generate that assessment;
  4. validation of the correct usage of software appropriate for the assessment;
  5. initial inspection of the manufacturing plant to validate any company-specific data.

This is specified in Annex IX, Section 4(b) of the Construction Products Regulation

The new Construction Products Regulation does not require any additional “validation.”

However, CE marking and the declaration of performance and conformity remain mandatory. From January 8, 2026, these will be expanded to include environmental and sustainability information and will be subject to stricter monitoring.

A solid data basis is crucial for validation. If sustainable certificates, verifications, or validations, such as a life cycle assessment (LCA) or carbon footprint, are already available, this can significantly simplify the validation of sustainability information within the declaration of performance.
